Old style flat packs - not CA legal?

I heard from a buddy of mine that they have started ticketing people at Pismo for non-CARB compliant gas containers - this includes the 5 gallon race cans, old school wal-mart gas cans, as well as the old flat packs. The fine is $50.

I am --> || <-- that far from not registering my bike in CA anymore, and only riding in Nevada.

I have had it with this state.

That does not make any sense....The old style were legal at one time. So every time they change a rule or code you are breaking the law ??????

I would imagine that Pismo is a high profile enforcement location....it's CONSTANTLY under threat of the Anti's. When I went to Pismo in 1974 and 1975....There were 25,000 acres of riding, there's now like 2500. You could drive from the entrance...all the way down the beach...like 5+ miles...all the way to the end...and there was a HUGE mountain, called Devil's Hill or Devil's Slide Hill....it was epic.

Point is....It's an easy enforcement place, due to the users in a concentrated area. I seriously doubt, CHP will be pulling over rigs with old school gas cans. At least I hope not.

As for the flat packs...in order to see which style nozzle there is...would require a search to open the top. Legal?

Nope, not unless you consent to the search. Never consent to search and refuse to answer questions about the flat pack or anything else. Repeat "am I free to go?" over and over until you are once again free of the government agent's clutches and back to happily riding around. If the stop was illegal in the first place (see Terry Stop) then consider slapping them with a 42 USC 1983 suit for deprivation of civil rights. Your friend Dan will be really handy if it gets to that. :)

Ha...I told him about the nozzles...and that I'll just keep repeating...am I free to go? And while video taping...when he gets agitated, and violates my rights...I'll call him.

Has anyone been able to find the code on this yet? Er...that is to ask, has anyone looked? I have found a bunch of old (2009-2010) threads in random forums about it, but haven't had any luck finding the official verbiage. That being said, is it bad to assume it's speculation at this point?

I haven't done any searches, but the laws (via CARB and the air quality police) are almost always over *sale* of things. Retailers can't *sell* things to Californians that are not CARB-compliant (for you out-of-staters, that the California Air Resources Board) with the stupid innovations that help you spill gas all over the place.

It would be interesting to know what the people are being cited for. Sometimes there are local laws regarding such things, which could be what they are being cited for down there. Example - in the Bay Area, home of the BAAQMD - the Bay Area Air Quality Management District - our house actually had to have a BAAQMD-approved WATER HEATER. So, instead of just meeting Federal Standards, they imposed their own and EACH water heater installed in houses had to meet their requirement and have a sticker showing same. It's INSANE.

That's right, here are the regulations. They don't apply to people like us who simply use our old containers. They apply to:
...any person who sells, supplies, offers for sale, advertises or manufactures for sale in California portable fuel containers or spouts or both portable fuel containers and spouts for use in California...
As you said, we need to know what these people are actually being cited for. It would say right on their ticket/citation.

That is just damn pathetic that california is so hard up for money that they invent new laws so they can go out and fine people that arn`t doing any thing wrong. What about people that are on vacation from another state that have the old style fuel packs or gas cans, how would they know about this rediculous law ?.
